Mephistopheles

Literature offers a great beginning to anything. From literature come so many ideas and characters that can fill up one’s imagination and carry on a certain tradition for ages. Many supernatural characters, like demons, have eventually been carried over from old literature. An example of one would be Mephistopheles. Mephistopheles is one of the seven chief demons from hell (Faust). He was originally featured in European literature traditions, German to be exact (Wikipedia). He starts as a cruel and cold-hearted fictional character, in the Legend of Faust, and carries on making appearances in other novels, plays, and songs. The name Mephistopheles came from Hebrew, where Mephitz means â€Å"destroyer† and tophel means â€Å"liar† (Etymonline). Others believe Mephistopheles may also mean â€Å"he who shuns the light† (White Roses Garden). The Legend of Faust by Johann Wolfgang van Goethe, written in 1773, introduces the character of Mephistopheles (Donald Tys on). Mephistopheles is a shape shifter who can shape into many forms, and his main purpose in the legend is to destroy and tempt Faust (White Roses Garden).Basically, he tries to trick Faust into selling his soul (Faust). Through Goethe’s book, he is known as a â€Å"fallen angel† as he clearly states to Faust† (Faust). â€Å"A late comer in the infernal hierarchy, Mephistopheles never became an integral part of the tradition of magic and demonology that predated by him for thousands of years. Mephistopheles achieves tragic grandeurs as he is torn between satanic pride and dark despair† (Encyclopedia Britannica). Other than the Faust legend, the name Mephistopheles is mentioned in various forms of modern culture. He takes place as â€Å"Mephistophilus† in Shakespeare’s Merry Wives of Windsor (Act 1, Sc 1, line 128) and in a book by John Banville (1911 Encyclopedia). The name Mephistopheles has been mentioned in songs by Radiohead, Watain, the Police, and much more. He is all too familiar in television and movies like: SNL, Family Guy, South Park, Batman Begins, The Dark Knight, and Ghost Rider. Mephistopheles also occurs in video games, board games, operas, comics, stage plays, and other literature (Wikipedia). â€Å"Mephistopheles is one of the demons of hell according to Christian literature and legend. He is mentioned in virtually every version of the Faust story as the infernal agent who entices the scholar to sell his soul to the devil† (White Roses Garden). This name has become well known and been mentioned in several forms of modern and pop culture (Faust). â€Å"The host of hell has also inspired numerous plays, paintings, and works of music† (White Roses Garden). Mephistopheles is a character who can be used in many forms of culture and has been created from the Legend of Faust. His dark and brooding personality makes him stand out, and it is likely that he will be remembered for generations to come .Works Cited Changeri, Heather. â€Å"Mephistopheles. † White Roses Garden. 2007. Daubert V. Merrell Dow Pharmaceuticals

Daubert v. Merrell Dow Pharmaceuticals Brandon Pond New England Institute of Technology Case Studies in Criminal Forensics CJ 372. 57 Professor Michael Pezzullo October 24, 2012 Daubert v. Merrell Dow Pharmaceuticals The 1993 Supreme Court case of Daubert v. Merrell Dow Pharmaceuticals, like many high-profile court cases, set a precedent for future court causes of a similar background. Merrell Dow Pharmaceuticals was a pharmaceutical company based out of Kansas City, Missouri which was founded in 1950.Originally named â€Å"Marion Laboratories† after its founder Ewing Marion Kauffman, Merrell Dow Pharmaceuticals specifically developed pharmaceuticals that had yet to be marketed by other pharmaceutical companies after being discovered and researched. As a result, Merrell Dow Pharmaceuticals are credited for producing several high-quality and extremely popular drugs even in modern day, including the Nicorette anti-smoking gum and Cepacol mouthwash. However, in an attempt to recei ve credit for popular and effective pharmaceutical production over other companies, Merrell Dow Pharmaceuticals earned a reputation of producing drugs without sufficient research of potential side-effects. As a result, Merrell Dow Pharmaceuticals were I involved in an extremely high-profile U. S. Supreme Court case, titled â€Å"Daubert v. Merrell Dow Pharmaceuticals. This 1993 court case put pressure on the pharmaceutical company to close their doors and sell the company just three years later in 1996. Jason Daubert and Eric Schuller were both born in San Diego, California with visible physical defects. At birth, Daubert was missing three fingers on his right hand and was missing a bone in the lower part of his right arm. Schuller was born without a left hand and a leg which was shorter than the other. In 1993, Daubert and Schuller, along with their parents, elected to sue Merrell Dow Pharmaceuticals, the manufacturer of the drug Bendectin, an anti-nausea medication both the boysâ €™ mothers were prescribed and consumed during their pregnancies. Bendectin had been already removed from the market in 1983 after numerous claims that the medication ad caused birth defects in children. Despite the claims that the drug had caused birth defects in a number of children, scientific research behind Bendectin showed no evidence that the drug is question produced birth defects in fetuses. The case was taken to a California state court, where it was ultimately moved to a Federal Court following a successful motion of diversity, ultimately meaning if a party in a case is established in a state differing from the state where the trial is being heard, the trial can be upgraded to a federal court. At the federal court trial, Merrell Dow Pharmaceuticals presented an expert witness, Dr. Lamm, who provided his opinion tht Bendectin has no proven components that are consistent with causing birth defects in humans. Following the expert witness presentation, Merrell Dow Pharmace uticals filed a motion for summary judgment, stating that following their presentation of a certified expert witness that stated Bendectin does not have components which produce birth defects, there was no longer a necessity for continuation of the trial.Schuller and Daubert, however, submitted a total of eight expert witnesses of their own possessing various accreditation and credentials, stating that Bendectin indeed had the potential of causing birth defects in humans. The eight expert witnesses expressed their opinions based upon a scientific study regarding in-vitro and in-vivo techniques during animal studies. During the time in which the case was heard in 1993, in-vitro and in-vivo animal testing was not recognized as a legitimate methodology that had not yet been established as common practice within the scientific community. As a result, the expert witnesses presented by Schuller and Daubert were deemed inadmissible in court, and Merrell Dow Pharmaceutical’s motion fo r summary judgment was approved at the district court level. Daubert then appealed their case to the appellate court at the 9th circuit court of appeals, re-introducing their expert witnesses’ opinion that Bendectin indeed can cause birth defects, backing their opinions with in-vitro and in-vivo research. The 9th circuit court determined that the district court had correctly approved Merrell Dow Pharmaceutical’s motion for summary judgement, using the 1923 U. S.Supreme Court Case Frye v. United States as their basis for their decision. Frye v. Unites States dealt with the inadmissibility of a blood-pressure lie-detection method into court proceedings because it had not yet become â€Å"generally accepted† as a reliable scientific practice. In addition, the 9th circuit stated that it was the court’s opinion that the evidence in which Daubert and Schuller were presenting was designated for litigation, and without their presentation of expert witnesses, Daub ert and Schuller had no sufficient evidence to prove that the Bendectin drug indeed can cause birth defects in humans. The 9th circuit court upheld the U. S. district court’s decision, but filed a motion of certiorari to the U. S. Supreme Court, anticipating the higher court to review their decision on the case, a motion the U. S. Supreme Court ultimately agreed to hear. At the U. S. Supreme Court, the court determined that â€Å"general acceptance† is not a justified precondition of the admission of scientific evidence into court. According to the Federal Rules of Evidence, there is no requirement that specifically stated that scientific evidence has to have a â€Å"general acceptance† in order to be admissible into court. In particular, Rule 702 of the Federal Rules of Evidence states that the judge during the trial has the discretion to determine whether or not an expert witnesses’ testimony is based upon a â€Å"reliable foundation† and is  "relevant to the task at hand†. The Supreme Court also determined that any evidence with â€Å"scientifically valid principles† will be sufficient to fulfill the two aforementioned requirements. Ultimately, the U. S. Supreme Court overturned the decision of the 9th circuit court of appeals, and eliminated Frye v.United States from judicial review practices during determination of evidence admissibility. After having the case reintroduced into the lower court, the lower court again sided with Merrell Row Pharmaceuticals, determining that there was no sufficient evidence that the use of in-vitro and in-vivo research methods fulfilled the task-relevancy and reliable foundation requirements. Despite the ruling, the Rule 702 of the Federal Rules of Evidence, currently known as the Daubert Test, has fully replaced the Frye Test in all evidence admissibility review cases.Overall, the Daubert v. Merrell Row Pharmaceuticals case has played an overwhelmingly significant role in m odern day Criminal Justice and the way court proceedings are carried out. This case is responsible for single-handedly changing the landscape in which evidence is analyzed for admissibility. Prior to this case, evidence admissibility was based around a U. S. Supreme Court case that was decided way back in 1923, 70 years prior to the Daubert case. The Frye Test had simply lost its base in modern day Criminal Justice, and the Daubert Test rovides justices within a court setting to have the overall determination of whether evidence fulfills two simple requirements. As more and more cases are presented into criminal courts, and more technological advances are produced, statutes, laws, and precedents need to change to accommodate for the new technology. In this instance, the Frye Test surrounded a blood-pressure style lie-detection test, technology that was so advanced and profound that it hadn’t even been considered an accepted scientific practice. In modern day, there are even mo re advanced forms of lie-detection software that individuals involved in the Frye v. United States case could not even imagine. There is no question that there needs to be some sort of decisive test to determine what types of evidence should be admitted into court proceedings, and what types of evidence should be excluded. Not all evidence can be included, because there would be no way of determining the credibility of the evidence being introduced into court. It would simply not be fair to a defendant at trial to be incriminated using evidence that isn’t proven to be sufficient, and would not otherwise pass some sort of evidence admissibility test. By using the Daubdert admissibility test, however, it provides judges leading a trial proceeding to have the overall determination of whether or not evidence fulfills the Daubert Test. The Daubert Test states that evidence must both have â€Å"scientifically valid principles† and must be â€Å"relevant to the task at handâ € .This may sound like a productive test for all evidence. I agree that the Daubert Test is indeed a good test, though only to some degree. One of the justices that heard the Daubert v. Merrell Dow Pharmaceuticals case at the U. S. Supreme Court level admitted that while he understood his ability to have the overall determination of all evidence admissibility in the case, the magnitude of scientific advancements involved in the case was certainly out of his expertise, as well as the other justices within the U. S. Supreme Court.I do not feel it is right to put evidence admissibility into the hands of justices whom have a expertise in legal practices and the judicial system, rather than bimolecular engineering, pharmaceuticals, or any other scientific field. However, with that said, I do feel that the Daubert Test is certainly a step in the right direction. I firmly believe that the Daubert Test will uphold until another case similar to the Daubert v. Merrell Dow Pharmaceuticals c ase will force new improvements into the standards of evidence admissibility. Works Cited Angier, Natalie. President Nixons International and Domestic Challenges

Name Teacher AP US History September 20, 2012 President Richard M. Nixon’s administration had to face many international and domestic challenges in the United States between 1968 and 1974, some positive and some negative. His achievements in expanding peaceful relationships with both China and the Soviet Union are contrastingly different with his continuation of the Vietnam War. In the end, Nixon’s scandals and abuse of presidential power caught up to him, and his administration did much to corrode America’s faith in the government. In 1968, Richard Nixon gave his acceptance speech at the Republican National Convention(Doc A).He said that it was time for a new leadership for the United States of America, and that new leadership was him. Nixon won in a very close election against Hubert Humphrey and promised to restore law and order to the nation’s cities. What everyone didn’t know was that for him to achieve his future accomplishments, he would dest roy the nation’s trust. A positive international challenge that Nixon was involved in was seeking better relations with China. Early in his first term, Nixon and his adviser, Henry Kissinger, began sending subtle proposals hinting at warmer relations to the People’s Republic of China’s government. When both countries hinted at this, Kissinger flew on secret diplomatic missions to Beijing and in July 1971, the President announced that he would visit the PRC the following year. This confused most American’s at the time because they believed that all communists countries were evil. When Nixon flew to China in February and he met with Mao Zedong. Nixon’s visit included a vast shift in the Cold War balance, putting the U. S. and China against the Soviet Union. Several months later, Nixon traveled to the U. S. S. R. and met with Leonid Brezhnev and other Soviet leaders. The result this trip was the signing of the Antiballistic Missile Treaty of 1972. The t reaty restricted the number of ICBMs each nation could manufacture and stockpile and it was part of SALT (Strategic Arms Limitations Talks). Nixon’s visits to China was a triumph because it contained the Soviet Union from expanding and gaining power. His visit to the U. S. S. R. was a diplomatic accomplishment because it improved relations with them. Nixon faced many international disputes during his presidency and some of them, he responded to negatively.Throughout the Vietnam War, President Nixon had sent a letter to President Ho Chi Minh stating that he believes the war has gone on to long and it needs to stop(Doc B). When the letter didn’t work, the biggest international challenge for Nixon was how to end the Vietnam War. Nixon and Kissinger both had a belief that they could end the war in six months, but they were proved wrong. In 1968, the same year Nixon was elected, there had been two huge events of the Vietnam War, the Tet Offensive and My Lai Massacre. Presid ent Nixon had inherited the burden of the Vietnam War and he asked the American citizens for their support(Doc D).Two months into his presidency, Nixon realized that there seemed to be no end in sight to the war. In 1969, Nixon ordered the secret bombing of Cambodia. The targets of these attacks were sanctuaries and base areas of the People’s Army of Vietnam and forces of the Viet Cong, which used them for resupply, training, and resting between campaigns across the border in the Republic of Vietnam. Nixon’s purpose for the bombing raid was because the first had been unsuccessful. The purpose of the secrecy was to protect Sihanouk. The way Nixon responded with the secret bombing was negative. He never told America or the Congress about it and that led to the distrust of the American citizens. Environmental concerns were a challenge but Nixon responded to them positively. In Nixon’s presidency, he started out opposing environmental laws. But then he realized that protecting the environment was popular and he saw it as a politically beneficial area. By the time of his resignation, he created more laws than any other president before him. In early 1970, President Nixon signed the legislation that became the National Environmental Policy Act. He announced it was the first symbolic act of â€Å"the environmental decade. Between the years of 1970 and 1972, Nixon created the Environmental Protection Agency and signed laws including the Clean Air Act, Clean Water Act, and the Marine Mammal Protection Act. Another thing he did was sign executive orders and international agreements on environmental issues. In early 1973, an international conference was held to discuss endangered species. The product of the conference was the Convention on International Trade in Endangered Species of Wild Fauna and Flora. The U. S. needed a new legislation to meet some of the agreement’s provisions and it led to the Endangered Species Act.In Nixon’s Sta te of the Union speech in 1973, he called for stronger wildlife protection. The results of these environmental laws and international agreements made the public extremely happy. Even though Nixon’s intentions were selfish when he got involved in environmental concerns, he responded unquestionably positive. All his hard work helped pave the way for a cleaner society. In 1973, an oil crisis began when the members of the OAPEC (consisting of the Arab members of OPEC, plus Egypt, Syria and Tunisia) proclaimed an oil embargo in response to the United States decision to resupply the Israeli military during the Yom Kippur War.The embargo happened when 85% of American workers had to drive to work every day. President Nixon had to set the course of voluntary rationing. He proposed an extension of daylight savings time, had gas stations hold their sales to a max of ten gallons per customer and a maximum speed limit of 5o miles per hour, and asked companies to trim down work hours(Doc H ). The price at the pump rose from 30 cents a gallon to $1. 20(Doc C). Nixon also had Congress approve of a Trans-Alaskan oil pipeline. Nixon responded to the recession the best way possible. The embargo was lifted on March 18, 1974.The downfall of Nixon was his worst domestic challenge. America found out about his scandals and it led to his resignation as president. The Watergate Scandal starts when Nixon won the 1968 election, one of the closest elections in U. S. history. In 1970, Nixon approves a plan for a greatly expanding domestic intelligence gathering by the FBI, CIA, and other agencies. A few days later he has second thoughts and revokes his approval. Then in June of 1971, New York Times begins publishing the Pentagon Papers. The Pentagon Papers is about the Defense Department’s secret history of the Vietnam War.In September of the same year, the White House â€Å"plumbers† unit burglarizes a psychiatrist’s office to find files on the former defense an alyst who leaked the Pentagon Papers, Daniel Ellsberg. The White House plumbers unit got their name from their orders to plug leaks in the administration. The year of 1972 is a busy year. On June 17, five men were arrested trying to bug the Democrats offices at the Watergate hotel. The Washington Post reported many things that year. One was that a $25,000 check wound up in the bank account of a Watergate burglar.Another was that John Mitchell controlled a secret Republican fund used to finance widespread intelligence-gathering operations against Democrats. Nixon was reelected president in one of the largest landslides in U. S. history in 1972 against George McGovern. His inaugural address said that since he was elected in 1968, America has been better(Doc F). But the truth was, that in 1973, Nixon was turning out to be anything but great. In the beginning of 1973, former Nixon aides G. Gordon Liddy and James W. McCordJr. , convicted of wiretapping in the Watergate incident. Then, H. R. Haldeman and John Ehrlichman, and Attorney General Richard Kleindienst all resigned over the scandal. John Dean, a White House counsel, was fired. In May, Elliot Richardson taps Archibald Cox as the Justice Department’s special prosecutor for Watergate. Later, in June, John Dean tells the Watergate investigators that he discussed the Watergate cover-up with Nixon at least 35 times and the Washington Post reports it. In July, Alexander Butterfield revealed in his congressional testimony that since 1971, President Nixon had recorded all conversations in his office. When the Senate asked Nixon for the tapes, he refused. On the Saturday Night Massacre, Nixon fired Archibald Cox and Elliot Richardson and William D. Ruckelsshaus resigned. When Nixon reluctantly agreed to hand over the tape, there was an 18 minute gap. Nixon kept giving them pieces of the tape when they asked for them(Doc G). He never just handed over all the tapes. The Supreme Court ruled that Nixon must turn ove r the tape recordings. In 1974, the Washington Post reported that the inevitable was nearing(Doc I).Nixon was faced with certain impeachment, so in August of 1974, Richard Nixon became the first ever president to resign and Gerald Ford became the next president. President Richard Nixon’s presidency had many ups and downs when it came to dealing with the international and domestic challenges in the United States between 1968 and 1974. His most notable domestic actions were economic, and his international actions were his priority. Despite his ruination and disgrace in keeping secrets from America, Nixon did help establish relations with Communist China and ended the Vietnam War.

Improving Interactions between Meeting Planners and Hotel Employees Research Paper

Improving Interactions between Meeting Planners and Hotel Employees - Research Paper Example The results of the primary research will be compared with that of the secondary research, in this case, the results of the surveys conducted by Rutherford and Umbreit, as embodied in the literature review. Literature Review Meeting planners can provide hotels with substantial revenue. Yet little empirical research has examined how hotel sales personnel might facilitate generating this business from meeting planners. (Lee et al, 2005) However, some have made these studies, and one of them is the study conducted by Zeithaml, Parasuraman, and Berry who developed an instrument for measuring customers' perceptions of service quality. The instrument includes dimensions of assurance, empathy, tangibles, reliability, and responsiveness. The most critical dimension was reliability. There is the performance of promised services. The next most critical was responsiveness, or the willingness to help customers and provide prompt service. The SERVQUAL method from Zeithaml, Parasuman, and Berry is a technique that can be used for performing a gap analysis of an organization's service quality performance against customer service quality needs. SERVQUAL is an empirically derived method that may bed used by a services organization to improve service quality. The method involves the development of an understanding of the perceived service needs of target customers (12 Manage Management Communities, 2007). These measured perceptions of service quality for the organization in question, are then compared against an organization that is "excellent". The resulting gap analysis may then be used as a driver for service quality improvement. SERVQUAL takes into account the perceptions of... Ways of Knowing - Assignment Example Nevertheless, enlightenment cannot be exactly known without discussing it in the context of ignorance. When one is ignorant, one is pictured as extremely sensitive and vehemently opposing something without even realizing why. For example, one is into anarchism, or the condition where one is â€Å"unrestricted by man-made law† and believes that â€Å"all forms of government rest on violence† (Goldman 583). This is actually such a negative standpoint from which to proceed. Nevertheless, the ignorant are relentless in believing that â€Å"God, the State, and society are non-existent† (584). This they proclaim while contending that â€Å"the individual is the heart of the society† and that â€Å"society is the lungs which†¦keep the life essence† (584). How then can society be the â€Å"lungs† that keep the individual alive when in fact it had previously been declared that the society is â€Å"non-existent†? Thus, the ignorant do not realize that their principles are actually contradictory. Moreover, if the great French anarchist Proud hon states that â€Å"Property is robbery,† then I am not even entitled to own my physical body lest I be called a robber (584). Why then should anarchism be the solution to all the ills of the world when anarchism can in fact totally annihilate everything? The ignorant stops here and cannot answer such a question. This is the problem of having contradictions. Such contradictions may have only been a theory by Goldman but they made up the entire philosophy of Marx and Engels – the philosophy of communism, which was loosely based on opposition. Judging only from their own limited or ignorant points of view, the authors contend that opposition exists among the social classes: â€Å"†¦every form of society has been based†¦on the antagonism of oppressing and oppressed classes† (Marx & Engels 487). If such oppression did exist in

Juvenile Serial Killers Research Paper Example | Topics and Well Written Essays - 1250 words

Juvenile Serial Killers - Research Paper Example Juvenile serial killers have become an occurrence in everyday contemporary life to such an extent that many in society have come to attempt to discover the origins of their behavior and what can be done to ensure that these occurrences do not happen again (Korbin, 2001). A number of juvenile serial killers have gained prominence in the media over the last few decades and it is these who will be studied to find out what they did to deserve their reputations as well as to find out where they ended up once they were caught, tried, and sentenced. One of the most notable juvenile serial killers in the modern age is Harvey Robinson, who raped and killed a number of women throughout his career as a serial killer. Robinson was a teenager who was well liked by all of those people who knew him and it was said that he was a young man who had everything going for him (Ramsland, 2012). In 1993, at the age of seventeen and over a span of one year, he was able to attack five women, three of whom he killed in cold blood. He was caught when a woman who he attempted to kill did not die and he was forced to escape because of the intervention of the woman’s neighbor. This led Robinson to the belief that the woman had identified him; hardening his decision to kill her before she could identify him. However, in anticipation of his return, the police asked the woman to be their bait and when he did indeed return, the police were able to capture him and put his into custody. During his trial, his defense team attempted to portray him as a young man who was mentally unstable hence deserving of leniency, especially considering the fact that when he committed the murders, he was still a minor (Schwartz, 2013). However, the jury and the judge took the side of the police and the evidence that they had provided proving that the Robinson in the court did not display any of the

Operation management of McDonalds Assignment Example | Topics and Well Written Essays - 2000 words

Operation management of McDonalds - Assignment Example This essay discusses that while the meanings of â€Å"operation† and â€Å"management† taken separately are commonly understood, when the two are combined an entirely different idea is formed. This field of business that seeks to define and standardise things could not itself be fully summed up in one comprehensive idea. Lawson perceptively pointed out that operations management is conceived of according to varying levels of scope and significance. Operations management has been variably defined as: (1) â€Å"The design, operation and improvement of the systems that create and deliver the firm’s primary product and service combinations†; (2) â€Å"The design, operation and improvement of the internal and external systems, resources, and technologies that create and deliver the firm’s primary product and service combinations†; and â€Å"The design, operation and improvement of the internal and external systems, resources, and technologies tha t create product and service combinations in any type of organization†. Mosby, Crumbaker & Urban observed that operations management is focused mainly on making sure that the firm’s business operations function efficiently and effectively, towards greater reliability and availability of the firm’s systems and services. Among the many duties and responsibilities which the operations manager is expected to fulfil, which generally fall within a five broad roles and responsibilities. ... These are identified and categorized by Operations Manager.com (2011) as: (1) Logistics management; (2) Budget management; (3) Operational strategizing; (4) Management of support services; and (5) Management of third party relations. According to Pycraft, Singh and Phihlela (2000), the exact responsibilities and role of operations management will depend primarily upon the nature of the organization’s business. In general, the classes of activities that operations managers directly discharge, which apply to all types of operations, include: (1) Understanding the operation’s strategic objectives; (2) Developing an operations strategy for the organization; (3) Designing the operation’s products, services and processes; (4) Planning and controlling the operation; and (5) Improving the performance of the operation (p. 31) In a survey conducted by Professor Arnoud de Meyer and reported in Pycraft, et al (2000, p. 33), a factory manager’s work was analysed and th e following breakdown was arrived at: Table 1: Breakdown of factory manager’s work Activity % of time Degree of change (1 = spending less time 7 = spending more time) Direct supervision and support Consulting with plant staff Consulting with upper management Consulting with sales and marketing Communicating with customers Communicating with suppliers Consulting with Research and Development Dealing with the community Training (as trainer) Training (as trainee) 22 16 12 10 7 7 5 5 4 4 3.5 3.9 4.0 4.8 4.8 4.4 4.7 4.5 4.6 4.6 Source: Pycraft, Singh & Phihlela, 2000, p.33 The foregoing table highlights the many varied concerns of the operations manager today. He is also responsible for ensuring that, we, as his children have access to quality education. This is also an area that he has been able to tackle very well. In as much as it is it is a requirement by the government I still feel that he is able to manage this role just fine. With all said and done, he is also a role model for the whole family. The president also serves a similar task as a father only that this time it is at the national level. At this level, some roles of leadership like role modelling may not be possible (Kouzes, and Barry 32). In addition, we don’t get to interact with the president on a day to day basis. I consider president Obama to be a good leader in so many aspects. Taking a look at his historical achievements, Obama has among others been able to bring an end to Al Qaeda through the killing of Osama bin Laden as well as Libya’s dictatorship. This can be considered to be great achievements by the

Defamation and the First Amendment Term Paper Example | Topics and Well Written Essays - 2000 words

Defamation and the First Amendment - Term Paper Example However, what is to be said of the extents of free speech guaranteed Americans in the First Amendment To what point does the First Amendment guarantee that someone may speak freely about someone else, albeit in a negative light Here, it will be examined: what constitutes defamation; what constitutes free speech as guaranteed by the First Amendment; and what happens in defamation cases. In other words, defamation of a person can range from someone making a comment or critique in presence of a third party, or can include written communications that a third party sees. (This does not include personal letters to one person that are not seen by a third party.)5 Anything defamatory is considered "that which tends to injure reputationdiminish[es] the esteem, respect, goodwill or confidence in which the plaintiff is held, orexcite[s] adverse, derogatory or unpleasant feelings or opinions against him."6 A communication is considered defamatory "if it tends to harm the reputation of another as to lower him in the estimation of the community or to deter third persons from associating or dealing with him."7 In this instance, the "meaning of a communication is that which the recipient correctly, or mistakenly but reasonably, understands that it was intended to express."8 First Amendment guarantees the freedom of speech, along with the freedom of religion, the press, and peaceful assembly. Specifically, the First Amendment reads as follows: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."9 Madison's original draft of the First Amendment read, 'The people shall not be deprived or abridged of their right to speak, to write, or to publish their sentiments; and the freedom of the press, as one of the great bulwarks of liberty, shall be inviolable.''10 If it had been approved, this would have probably been a much more liberal version of the amendment than we have now. To speak, write, and publish one's sentiments without being deprived or abrid

Case Study 4 Essay Example | Topics and Well Written Essays - 250 words

Case Study 4 - Essay Example Our objective will be to optimize the application of our dataset toward more effective CRM. The set includes both audio-visual information and electronic-data information. To focus efforts and avoid legal ethical questions, we will concentrate of the electronic-data portion. This mainly includes information gathered from telecommunications and membership cards transactions. The end product would include a GUI expressing the current trends in customer behavior and accepting inputs that translate into operational measures and investigate correlations to help optimize our influence over buyer behavior. The reasons for not using all of the available data is two-fold -- one is ethical, the other operational. The operational reason is work flow related. To avoid scope creep, we limit our focus on each component of any project. The ethical reason is about questions of personal privacy in a public way. While applying numerical data is more objective because any identifying information may be stripped from the dataset during data analysis. However, it may not be outside the scope of an expanded version of this process to apply some of the audio-visual

Plagiarism - Research Paper Example Many academic writers consider is acceptable, but in fact this constitutes plagiarism. Compilation is a practice of compiling various chunks of information from a variety of sources to meet the requirements of the paper that is being written. Even if very little information is taken in this way from other sources, it still constitutes plagiarism. Direct quotation – when exact or near-exact words of another author are used in an academic work; the practice is known as direct quotation. Although rarely used in engineering, a direct quotation is often enclosed in inverted commas while being italicized. Plagiarism may be intentional or unintentional. Unintentional plagiarism may be the result of a referencing error like attributing a work to an unrelated author, misquoting or failing to mention the work of an author in the document. Intentional plagiarism on the other hand may be ignorant or malicious. Learning and improving the writing skills while adopting good time management techniques may assist in avoiding plagiarism. Academic writing involves a higher level of dedication on part of the writer to produce a work that is academically acceptable. Having a sound knowledge of the referencing allows a writer to avoid plagiarism which is an unforgivable sin, in the world of academic works. For this reason, every student should have the basic understanding about referencing and plagiarism. This will enable the student to produce effective academic content that will ultimately improve his

The Impacts of Fast Food Essay Example for Free

The Impacts of Fast Food Essay The Impacts of Fast Food Fast food can be a cheap, quick meal, but most people do not realize what they are actually getting into. While some may say that the fast food industry has helped the world because it allows people with low incomes or not a lot of time on their hands to be able to get a fast meal, there are plenty of side effects to go along with it. The fast food industry has been developing quickly and has successfully roped in the human race. These restaurants are widely accepted because of their inexpensive food that is extremely addicting. Most people fail to see the other part of the story. In today’s society, fast food seems to be at the top of everyone’s meal list, but at the bottom of his or her concerns. Fast food impacts the economic, agricultural, and health fields. Some people believe that the fast food industry has no bad affects. Even though there are some positive points of it, people should start to also take notice of the negative points. The fast food industry provides jobs for lots of people throughout the world. There are more than 3. 5 million Americans who have been employed with a job in the fast food business (Peterson). This job appeals to lots of people because the employees do not have to be skilled to flip a burger or work a cash register. However, having a job at a fast food restaurant is not always a good thing. With low salaries, the economy cannot improve (Peterson). When there are so many people who have low salaries, nobody is going to be able to afford anything. Susan Peterson, a Ph. D in text theory from the University of Texas, says, â€Å"People work to make money, but what if they are not making enough to get by without help from the government? Susan has a very valid point. If people are not making enough money in their fast food job, how are they going to buy material needs for them or their family? It is great that they have a job and are working to earn some money, but that is not going to solve everything. Robby Kukler, a partner at Atlanta-based 5th-group-restaurants, says, â€Å"We live in a very cost-sensitive industry† (Bowman). Human dependency has played a large role in fast food. When there are so many people who consume fast food regularly, by logic, the industry is going to grow. A survey taken in the beginning of 2013 states that there are about 184, 200 fast food restaurants in America (Burks). Fast food restaurants are meant to be convenient, but when there are so many, too many people eat it too often. In the past forty years, the whole fast food industry has grown from a $6 billion revenue to a $170 billion revenue (Fast Food). Even though that seems like a large amount of time for a small growth, it is not. That is more than $4 billion per year. In 1968, there were only one thousand McDonalds in the United States. Now, there are more than thirty thousand (Cohen). With the rapid growth rate of fast food restaurants, it is just going to get easier and easier for humans to depend on fast food. While fast food affects the economy very heavily, it also impacts thousands of farms all around the country and even the world. Most people do not even know what they are eating when they are consuming fast food. In many places, there are vast amounts of corn and soybeans that become animal feed or ingredients in processed foods (Boyd). As a matter of fact, about 20 percent of the world’s petroleum production goes into the production and transportation of our food (Boyd). Because of this, the food we eat does not come from around the state anymore, but from all around the country or even the world. What people now call â€Å"fresh foods† can come from anywhere. It can be shipped as close as right around the corner, but as far as 1,500 miles away (Garrison). Why would a person want to eat something in which he or she does not know the ingredients or process involved in making it? A typical hamburger contains meat from dozens or even hundreds of different cattle from all around the world (Schlosser). The meat in hamburgers and even chicken nuggets used to come from a few or ever just one cattle (Schlosser). Therefore, if only one cattle is infected with a disease or sickness, there is a good chance that the person who consumes this meat will encounter some of the disease (Schlosser). People should really start to watch what is in the food that they are eating. Most people do not know that in a typical fast food strawberry milkshake, there is a substance used to clean oil rigs (Cohen). This is just one example of people not knowing what is in their food or drink before they consume it. Farms used to be very diverse, growing corn, oats, wheat, hay, fruits, and vegetables (Boyd). To feed a population as large as this one, farming is needed. In America, McDonald’s is the largest purchaser of beef, pork, and also potatoes (Cohen). McDonald’s is also the second largest purchaser of chicken in the United States (Cohen). Without agriculture, the human race would go nowhere in their everyday lives. It is only because of agricultural surpluses that we, as humans, were able to develop science, literature, and all of the other things we like so much (Cohen). We also do not have to fight for survival because farming and agriculture makes it so easy to put dinner on the table and feed people so easily (Cohen). Without agriculture we would not have such an advanced world today.

Physico-Chemical Analysis of Sugar Industry Effluents

Physico-Chemical Analysis of Sugar Industry Effluents Physico-Chemical Analysis of Sugar Industry Effluents of Gayathri Sugar Factory Nizamabad district, Telangana state Bondugula Vanitha, Dr. Nirmala Babu Rao, ABSTRACT Present work is based on the physico – chemical analysis of effluents released from gayathri Sugar Factory. Sugar mills place a major rolling polluting the water bodies by discharging a large amount of waste water as effluent. The sugar mill effluent are having high amount of Suspended solids, dissolve solids, BOD, COD, Chlorides, Sulphates, Nitrates, Calcium and Magnesium. The Continuous use of the Effluents harmfully affects the crops when used for Irrigation. It was found that the sugar industries consume large amount of water and released almost equal amount effluent containing highly toxic material in solid and dissolve form. Sugar Factory effluents was more worst like Average values of lower PH (6.2), high temperature (42Ã ¢-Â ¦c), chloride (862mg/ lit), total hardness (571mg/lit), calcium (362 mg/Lit), Magnesium (211 mg/Lit), total solids (2452 mg /Lit), Total Dissolved solids (1915 mg/Lit), Total Suspended Solids (542 mg/Lit), Nitrate (0.8 Mg/Lit), Phosphate (9.8mg/L it), Sulphate (49.3 mg/Lit) and Oil Grees (87.8 mg/Lit). And finally this water is Unsafe for domestic and agriculture purposes. Therefore it should be recycled and utilized for Industrial purpose only. Key words: Gayathri Sugar Factory, Sugar Factory Effluents, Physico Chemical Analysis INTRODUCTION: Sugar mills play a major role in polluting the water, land and air. Commonly the pollutants are through effluents and hazardous chemicals in the form of air (1). Sugar industry plays an important role in the economic development, but the effluents released will produce a high organic pollution in both aquatic and terrestrial and air ecosystems (2). Metals and non-metallic elements can be useful for the agricultural seed germination and growth, but in high concentration they show a very adverse effect (3). Effluents also affect characteristics like flora and fauna of receiving aquatic bodies, effluent discharged in the environment poses a serious health hazard to the rural and semi-urban populations that use stream and river water for agriculture and domestic purposes. Damage to paddy crops due to sugar industry waste-waters entering agricultural land have been reported (4). It had been reported that the lower concentration of sugar factory effluent increases the seedling growth (56). As sugar factory effluent not treated properly, it will have an unpleasant odor when it is released into environment (7). Farmers using effluents water for irrigation to reduce water demand have found that plant growth and crop yield were reduced and soil contaminated(8). This is also causing deaths of domicile animals of such polluted water have been reported increasingly (9). MATERIALS METHODS: The effluents from Gayathri sugar factory was collected during the beginning of rainy season (2013 July -2014 June) in the glass bottles from the discharge channel and properly sealed. It was preserved by adding chemicals to analyze in the laboratory, for the assessment of various physico-chemical characteristics a standardized protocol of APHA (10) was used. RESULTS DISSCUSSION Color As per the present study, the color of untreated effluent was dark brownish. The photosynthesis activity is found to be reduced due to dark coloration also affecting other parameters like temperature DO and BOD etc. Temperature Temperature plays an important role in certain chemical and biological reactions taking place in water which affects organism’s metabolic activity. It depends upon season, time sampling etc. The effluent which had been released from the industry has generally high temperature and it affects land. The temperature of untreated effluent was recorded 43Â °C. The temperature of the discharge should not exceed 35Â °C. The high tem i.e. 43Â °C of the untreated effluent has adversely affected the process. pH In the present study, pH values of treated and untreated are 5.8 and 6.2 respectively. According BIS standards pH of the effluents should be in the range of 6.5 to 8.0. These low pH values of both treated and untreated samples are due to usage of phosphoric acid and Sulfur dioxide during the process of cleaning of sugar cane juice. If such water is used for irrigation for a longer period the soil becomes acidic resulting in poor crops growth and yield. Dissolved Oxygen The analysis of Dissolved Oxygen (DO) is one of the very important factors in water pollution and waste water control. Aquatic ecosystem totally depends on DO only. It effects the metabolic activities of microorganism were very well documented. According to the BIS standards, the DO of effluent should be within the range 4 to 6 mg/lit. In the present study, DO of the untreated effluent sample was recorded 1.16 and 2.23g/lit respectively which is sufficiently low than the BIS Indian standard values. BOD Biochemical Oxygen Demand (BOD) is defined as amount of oxygen required by microorganism while stabilizing biological decomposable organic matter in water under aerobic conditions. The BO is a very slow process in oxidation; organic pollutants are oxidized by microorganisms into carbon dioxide, water using dissolved Oxygen. In the present study, the BOD of the untreated effluent was 86mg/lit. According to BIS Indian standard the BOD should not exceed the 50 mg/l. COD The chemical Oxygen demand test describes the amount of oxygen required for chemical oxidation of organic matter with the help of strong chemical oxidant. The COD is a test which is used to measure the amount or quantity of pollution which has been released by domestic and industrial waste. COD is useful to determine the exact toxic condition and presence of biological matters. In the present study, the COD of the untreated effluents was 460 mg/l. In untreated effluent it is appreciably high compared to BIS standard (250 mg/L). This indicates a high amount of organic pollutants in the sample. TDS The total dissolved solids concentration in the effluent represent the colloidal form and dissolved specters. The rate of collision aggregated process is also influenced by pH of this effluent. In the rainy season less concentration of total dissolved solids are obtained due to dilution of waste effluent with rain water. In the present study, the total solids in untreated effluent were 1958 mg/lit. The samples in TDS values are much higher compared to BIS Indian Standards (500 mg/L). TSS Suspended solids are the cause of suspended particle inside the water body influencing turbidity. According the present study, the suspended solids of untreated effluent were542mg/l Chlorides The presence of chloride in natural water is attributed to dissolution of salt deposit, discharge of effluents from chemical industries oil well operations. In the present study chlorides of untreated was 862 mg/l. Sulphate Sulphate can also be produced an oxidizing action as in the oxidation action. Sulphur itself has never been limiting factor in aquatic system. In the present study, sulphate in untreated effluent was 493 mg/l according BIS Indian standard, the sulphate should not exceed 100 mg/l. Oil and grease In the present study, oil and grease present in un-treated effluent showed 87.8mg/l oil and grease values are higher than BIS standards. Table: 1 Seasonal variation in the Physico- Chemical parameters of the un-treated sugar factory effluents (during period of 2013 July -2014 June) Table: 2 The Physico-chemical parameters of untreated sugar mill effluent CONCLUSION The Gayathri sugar industry situated at Nizamabad district, Telangana State is one of the good factories. It has own distillery unit in its own premises for waste which is generated from the sugar factory. The sugar industry needs modification in effluent treatment. Thus the sugar industry effluent which is untreated exhibits high COD, BOD, and TDS content. And low content of DO which is toxic to plants and animals, so it is not permissible for irrigation. The sugar industry effluent is highly polluted and they do not satisfy the BIS Indian standard values

Leonardo da Vinci :: History Biography

Leonardo da Vinci Painter, sculptor, inventor. Born April 15, 1452 near the village of Vinci, Italy. He was the illegitimate son of Ser Piero da Vinci, a prominent notary of Florence, who had no other children until much later. Ser Piero raised his son himself, a common practice at the time, arranging for Leonardo's mother to marry a villager. When Leonardo was 15, his father apprenticed him to Andrea del Verrocchio, the leading artist of Florence and a characteristic talent of the early Renaissance. A sculptor, painter, and goldsmith, Verrocchio was a remarkable craftsman, and his great skill and passionate concern for quality of execution, as well as his interest in expressing the vital mobility of the human figure, were important elements in Leonardo's artistic formation. Indeed, much in Leonardo's approach to art was evolutionary from tradition rather than revolutionary against it, although the opposite is often true of his results. After completing his apprenticeship, Leonardo stayed on as an assistant in Verrocchio's shop, and his earliest known painting is a product of his collaboration with the master. In Verrocchio's Baptism of Christ (ca. 1475), Leonardo executed one of the two angels, a fact already recorded in the 16th century, as well as the distant landscape, and he added the final touches to the figure of Christ, determining the texture of the flesh. Collaboration on a major project by a master and his assistant was standard procedure in the Italian Renaissance. What is special is that Leonardo's work is not, as was usual, a slightly less skilled version of Verrocchio's manner of painting but an original approach altering it. It completely possesses all the fundamental qualities of Leonardo's mature style and implies a criticism of the early Renaissance. By changing hard metallic surface effects to soft yielding ones, making edges less cutting, and increasing the slight modulations of light and shade, Leonardo evoked a new flexibility within the figures. This "soft union," as Giorgio Vasari called it, is also present in the special lighting and is emphatically developed in the spiral turn of the angel's head and body and the vast depth of the landscape. Apparently Leonardo had painted one extant work, the Annunciation in Florence, before this. It is much nearer to Verrocchio in the stability of the two figures shown in profile, the clean precision of the decorative details, and the large simple shapes of the trees, but it already differs in the creamier modeling of the faces. Navaids in Aviation :: essays research papers

Ã‚  Ã‚  Ã‚  Ã‚  How would pilots ever get around so easily without the help of navigation aides? Navigational aides have been around for almost as long as aircraft have been flying in the skies above us. The first navigation system was composted of just a high intensity-flashing beacon. These beacons were placed on the flight routes that were popularly flown in the mid 1920’s. With more time more of these technologies that help us navigate the world will be even simpler than today. This paper will explain how some navigational aides work and how some of them came into existence. Flight Management Systems Flight management systems are one of the best navaids in commercial aviation. The flight management system (FMS) is made up of four systems in an aircraft, the FMC (flight management computer), the autopilot and flight director, the auto throttle, and the IRS’s. According to Boeing the FMS could be defined as, being capable of four dimensional area navigation (latitude, longitude, altitude, and time), while optimizing performance to achieve the most economical flight possible. The flight management system can give you gross weight of the aircraft, and the best speeds (i.e. holding, approach, climb, cruise, descent, etc†¦) by taking inputs from the fuel summation unit when it is given the zero fuel weight and the MACTOW (mean aerodynamic cord at takeoff weight). The position of the aircraft can also be determined by referencing the IRS, along with GPS and the radio position updating. Global Positioning Systems GPS is a navigational aid that is satellite based. It is made up of a network of 24 satellites in orbit around the world. The first satellite was launched in 1978 and the last was put into orbit in 1994. Every 10 years another satellite is put into orbit because each satellite is made to last that amount of time. The system began as a military application but in the 1980’s the government decided to make it available to everyone, anywhere, anytime. The system finds your position by measuring the time it takes to receive the signal back to the satellite. It then does that with other satellites to triangulate your position in relation to the earth. To calculate a position in 2D the system has to be locked on to at least three satellites, but for a 3D representation you need to be locked on to at least 4 satellites. Once the position is found the GPS can calculate much more info like speed, bearing, track, distance, etc†¦ The GPS system is very accurate; Garmin (a leader in G PS technology) states that their newest receiver is accurate up to an average of 15 meters.

Blind Faith Exposed in The Victim of Aulis :: Victim of Aulis Essays

Blind Faith Exposed in The Victim of Aulis      Ã‚   During World War II, an entire race of people was decimated as a result of blind adherence to one charismatic ruler; the holocaust has become emblematic of the senseless horror of war and the loss of innocent lives. Perhaps influenced by World War II, the Korean War, and the questioning of complete adherence to authority, whose seeds were just breaking through the glorious faà §ade of the 1950's suburban idyll, Dannie Abse wrote "The Victim of Aulis" in 1951-6. The poem is an accusation against the disastrous effects of blind obedience, particularly as it is manifested in religion and war. Abse anchors his critique within the safely distant realm of Greek mythology; this creates a world with which most readers are familiar and thus transfers his indictment of modern society into the images of the cultural psyche. The poet borrows a scene from Greek mythology depicting the sacrifice of Agamemnon's daughter Iphigenia to Artemis at the beginning of the Trojan War, which serves as the ultimate expression of the intimate intermingling of war and religion.      Ã‚  Ã‚  Ã‚   The Greek gods were not only intimately involved in the action of the Trojan War, they were also the impetus for the war. Although the overt cause of the war was Paris' abduction of Helen, this act was the result of quarrelling goddesses. The Trojan prince Paris was forced to choose the fairest amongst the goddesses Hera, Aphrodite, and Athena. Each goddess attempted to sway Paris with offerings, and Aphrodite's temptation was Helen; this leads to the war and the immortal alliances that overshadow its mortal activities. The story that the poem implicitly addresses is of the Achaen king Agamemnon and his daughter Iphigenia. The Achaen forces have gathered at Aulis before mounting their attack on Troy when one of Artemis' stags is killed; this, coupled with Agamemnon's boasting of the act, is why "Artemis is offended" (51). In retaliation, the goddess imprisons the troops at Aulis by preventing the wind from powering their fleet. In order to appease the god dess and begin the war, Agamemnon sacrifices his own daughter Iphigenia as "the child" who will become "the victim of Aulis." Although Artemis intervenes and makes Iphigenia one of her priestesses, only the goddess knows that Iphigenia escaped death.

Wheelchair Experiement

The Wheelchair Experiment Why do people feel that it is acceptable to judge others? Why is it so difficult to lend a helping hand? During my brief time in a wheelchair, I discovered that hate and judgment towards individuals with disabilities still exists. For this project, I visited a local Target location and used a motorized wheelchair to navigate around the store. Through my time in a wheelchair, I discovered how difficult life could be if I were dependent on a wheelchair. As an able bodied adult, I did not like being immobile. My new found immobility left me feeling judged and alone in the world. At the age of twenty-four years old, I have never felt more judgment in my entire life than I did while I was in Target. I got many glances from children, and some adults glared at me as though it was my fault that I was in a wheelchair. I completely understood the daily challenges that go along with being disabled. Simple tasks like going to the restroom, trying on clothes, and reaching the top shelf for items became stressful and tiring. These tasks were made even more difficult when able bodied adults were not willing to assist me. Within the first thirty minutes, I had attempted to use the restroom and the fitting rooms. These were probably the most difficult tasks I attempted. While trying to get into the restroom, I noticed an employee laughing at me. Once he realized that I noticed him, he immediately stopped. Because the employee made me feel ridiculed, I left the area and did not go back. Shortly after the restroom incident, I attempted to use one of the fitting rooms. While attempting to use the fitting room, I noticed that the employee at the counter was not very helpful. She was not willing to remove carts that were obstructing the pathway. The fitting rooms clearly have handicap access, but because of the employee’s unwillingness to assist me I was unable to take advantage of these facilities. The situation left me feeling so uncomfortable, that I gave her the clothes in my cart and went to another part of the store to continue my shopping. During my final thirty minutes in the store, I noticed a couple that kept howing up on the same aisles as me. The couple consisted of a man and a woman who was using crutches to maneuver around the store. Because the woman was on crutches, I assumed that they would be understanding and helpful to someone else who also had a handicap. I noticed that the man willingly assisted the woman whenever she needed help, but he would photograph me struggling to reach an item on the top shelf. His actions left me feeling confused, helpless, and embarrassed about being in a wheelchair. As my journey through Target was coming to a close, I had lost hope that genuinely nice people still existed, until two employees proved me wrong. As I approached the register and checked out, the cashier assisted me by removing the items from my cart. After I checked out and paid, she graciously placed the purchased ite ms back into my cart. Immediately after I checked out, a security guard approached me and asked if I needed any assistance. The security guard walked me to my car and helped load my purchases into my car. Before this experiment, I did not recognize how mean and heartless individuals could be to someone with a disability or handicap. This experiment has taught me to always help others. Regardless of how someone physically appears, everyone is the same on the inside. Everyone has a heart and emotions, and both can easily be destroyed by another’s inconsiderate actions. Because of what I have learned through this assignment, I will always try to lend a helping hand to those in need. An Analysis of the War Powers Act of 1973

One of the hallmarks of a presidential and democratic society is the division of magnates among the three master(prenominal) firstes of governance. This is called the article of faith of the separation of powers or the principle of checks and balances. This principle seeks to prevent the over concentration of authority in wholeness person or group of persons that office lead to an error or ab manipulation to the detriment of the whole state.Austin Ranney (1995) once verbalize that whatever(prenominal) concentration of powers in a single branch is tyrannical and only true separation of powers leave behind hold dear the liberties of the people against the aggressions of giving medication. (Austin Ranney, p. 240) The principle of separation of powers has ever been criticized as impeding the enactment of bills and promoting efficiency in the running of the affairs of the government. It is because of this reason why or so democratic countries have amended their constituti ons and shifted to the parliamentary system. state of state of fight Powers Act of 1973 A concrete example of the article of faith of Separation of Power is the warfare powers which the US piece of music has entrusted to the Executive and the Legislative Branch. Under the unify States shaping, it whitethorn appear that the delineation of war power mingled with the Legislative and Executive Branch is unfastened. The habit is to defend sure that no one branch of government pass on have the absolute prerogative in making all decisions in matters pertaining to war.Article 1 Section 8 of the unite States Constitution understandably expresses that the social intercourse shall have the following powers a) To decl be state of war, appointment letters of marque and reprisal, and make rules concerning captures on bestow and water b) To raise and support armies, unless no appropriation of money to that use shall be for a longer term than cardinal years c) to countenance a nd chief(prenominal)tain a navy d) to make rules for the government and regulation of the land and naval Forces e) to offer for the occupation of the militia to execute the Laws of the Union, suppress insurrections and repel invasions f) to provide for organizing, arming, and disciplining, the militia, and for governing such(prenominal) part of them as may be employed in the service of the unite States, reserving to the states respectively, the appointment of the officers, and the authority of training the Militia accord to the discipline prescribed by congress. On the new(prenominal) hand, under Article II Sec. 2 of the get together States Constitution the chairwoman shall have the following powers a) The president shall be Commander in Chief of the regular army and navy of the join States, and of the militia of the several States b) The president shall have power, by and with the advice and consent of the Senate, to make treaties, provided two thirds of the senators pres ent concur. Based on these two provision in the get together States Constitution, the war powers appear to be clearly divided in the midst of the two briny branches of government.Under these provisions, the President has the power to lead the arm forces in propagation of war and to make fleet decisions on the field of battle. ( war and Treat Powers) On the other hand, the sexual relation has the power to declare war and to appropriate huge amounts of dollars in support of the war effort. The clear division of powers between the two main branches, however, appear to be more apparent than real. In between these two powers lie a nothingness which the framers of the constitution failed to consider. For any other decisions that the US Constitution failed to anticipate, it appears that the President has complete freedom and absolute free will to act. This is something which is abhorred by our constitution. Consider the Korean war in which the United States army was intensely invo lved. The Korean fight began as a civil war which was fought from 19501953 on the Korean Peninsula. It began when North Korean attacked southwestern Korea on June 25, 1950. (Korean War) Eventually China and the United States became involved in this conflict. Although it was called the Korean War, the United States favored to call it the police action rather than a war in order to avoid the destiny of conventional declaration of war by the copulation of the United States. The same thing happened during the Vietnam War or the Vietnam Conflict. This war lasted for 16 which began from 1959 to 1975. (Vietnam War) This involved the United States, its allies and the South Vietnam against Soviet Union, its allies and the pluralitys Republic of China and the North Vietnam. In this war, the U. S. deployed large numbers of troops to South Vietnam between 1954 and 1973. Some U. S. allies like the Philippines, Australa and New Zealand likewise sent their troops to aid the United States an d South Vietnam. Similar to the Korean War, the United States was to a fault intensely involved in this war without a formal declaration of war by Congress. These two major(ip) events in our storey have triggered the enactment of the War Powers Act of 1973.It is worth stressing that based on our news report Congress has formally tell war in only five conflicts the War of 1812, the Mexican War, the Spanish-American War, homo War I, and World War II spell U. S. presidents have committed armed forces to more than one hundred charge operations around the world. (Charles F. Williams, 2003) The purpose of this practice of law is to provide for a sication on the powers of the President to deploy United States troops into combat areas without the approval of the legislative branch. Congress aims to prevent the initiative that another Korean and Vietnam Wars may be restate where the United States deployed its soldiers for battle without the formal declaration of war coming from t he Congress.Section 2(a) of the said law is clear on this matter, it states that It is the purpose of this joint resolution to gather the intent of the framers of the Constitution of the United States and insure that the corporal judgment of both the Congress and the President will apply to the introduction of United States build up Forces into hostilities, or into situations where imminent matter in hostilities is clearly foreshadow by the circumstances, and to the continued use of such forces in hostilities or in such situations. Under the said law, the president is required to consult Congress in both possible instance before introducing United States arm Forces into hostilities or into situation where imminent involvement in hostilities is clearly indicated by the circumstances, and after every such introduction shall consult regularly with the Congress until United States Armed Forces are no longer engaged in hostilities or have been outside from such situations. The War Powers Act of 1973 also requires the President to submit within 48 hours to the Speaker of the family of Representatives and to the President pro tempore of the Senate a report, in writing, place setting forth the circumstances necessitating the introduction of United States Armed Forces, the constitutional and legislative authority under which such introduction took place and the estimated scope and duration of the hostilities or involvement in case United States Armed forces are actually introduced for combat. The said law also requires the President to send packing within sixty schedule days after a report is submitted any use of United States Armed Forces unless the Congress has declared war or has enacted a specific performanceiveness for such use of United States Armed Forces or has extended by law such sixty-day occlusive or is physically unable to meet as a result of an armed attack upon the United States. The sixty-day period shall be extended for not more than an addi tional thirty days if the President determines and certifies to the Congress in writing that unavoidable military exigency respecting the safety of United States Armed Forces requires the continued use of such armed forces in the course of carry about a prompt removal of such forces. The Congress by concurrent resolution is veritable at all times to order the withdrawal of US troops. Arguments against War Powers Act of 1973 One of the arguments raised(a) against the enactment of the War Powers Act of 1973 is that it is an act of ravishment on the part of the Legislature of a rule which the US Constitution has delegated to the Executive Branch. It must be stressed that the President took his oath before he assumed his office that he will faithfully execute the Office of President of the United States, and he will to the best of his ability preserve and protect and defend the Constitution of the United States. The present written significantly limits the powers of the president to act in times of war which have a serious effect on the performance of his obligation. Arguments In Favor of War Powers Act of 1973 On the other hand, some are in favor of the War Powers Act of 1973. They cope that the consultation and reporting requirements and the power of Congress to terminate the deployment of armed forces do not operate to limit the powers of the president. It merely serves to ensure that the constitutional mandate is observed. As envisioned by the United States Constitution, there shall everlastingly be two marks to start the engine of war running the key given to the Congress and the key given to the President. Thus, the War Powers Act of 1973 does make Congress superior to the President, rather, it only highlights the supremacy of the United States Constitution. expiry I believe that the War Powers Act of 1973 is constitutional. Our history has shown that we cannot entrust to a single man the power to deploy United States troops to combat. In the his torical decade, all the past presidents, including our present president, has deployed hundreds of thousands of US soldiers to battle. This not only led to the death of countless soldiers but it has depleted our resources. The United States Constitution is still the highest law of the land and it is clearly manifested in the enactment of the War Powers Act of 1973.
